Terms of Service

1. Service Provider
The Lokly service is provided by Raffaele Lugibello, Via Tancredi D'Altavilla, 73026 Melendugno (LE), Italy. VAT no. 05334840757. Certified email: raffaelelugibello@pec.it — email: info@lokly.it.
2. Acceptance
By using the Lokly app or website you fully accept these Terms. If you do not accept them, you may not use the service. Material changes will be notified by email and in-app at least 15 days before they take effect.
3. Eligibility
You must be at least 16 years old. To register as a Restaurateur you must be of legal age and have authority to represent the venue you register.
4. Accounts
Two account types exist: Customer (free — discover venues, save favorites, write reviews) and Restaurateur (paid — manage venue profile, menu, photos, events, reply to reviews). You are responsible for safeguarding your credentials and for all activity on your account.
5. Nature of the Service
Lokly is a discovery platform for restaurants and venues. Lokly is not a booking service, a delivery service or an agency: any relationship between Customer and Restaurateur is directly between the parties. Information published by Restaurateurs (hours, prices, menus, events) is their responsibility and Lokly does not guarantee its accuracy.
6. Restaurateur Subscription
- Price: €20/month, VAT included, recurring charge via Stripe.
- Free trial: 30 days from the first venue registered.
- Renewal: automatic at the end of each period unless cancelled.
- Cancellation: any time from the app or by writing to support@lokly.it; effective at the end of the paid period, no pro-rata refund.
- Right of withdrawal: 14 days from first subscription under the Italian Consumer Code, unless you have already actively used the service (e.g. uploaded content or received reviews).
- Failed payment: profile suspended, 30-day grace period to remedy, then cancellation.
- Price changes: notified at least 30 days in advance; failure to cancel implies acceptance.
7. User-Generated Content
By uploading reviews, photos or text you warrant that you have the rights to do so and that you do not infringe third-party rights. You grant Lokly a non-exclusive, royalty-free, worldwide and sub-licensable license to use the content for the service and its promotion while your account is active. Reviews must reflect genuine experiences; false, defamatory, offensive or privacy-infringing content is prohibited. Lokly may remove infringing content with reasoned notice.
8. Prohibited Conduct
Prohibited: spam, unauthorized scraping, unauthorized access to other accounts, rating manipulation, uploading malware or phishing links, using the service for unlawful purposes or to impersonate others. Violations may result in suspension, ban and reporting to authorities where applicable.
9. Intellectual Property
The Lokly trademark, logo, design and software belong to the provider and may not be used without written permission. You retain ownership of the content you upload, subject to the license set out in §7.
10. Limitation of Liability
The service is provided "as-is". Lokly is not liable for temporary unavailability, the accuracy of data published by Restaurateurs, experiences at venues, or data loss caused by user negligence. Mandatory liabilities under Italian law remain unaffected.
11. Suspension and Deletion
You can delete your account at any time from the app. Lokly may suspend or terminate accounts that breach these Terms, with prior notice. Personal data is erased within 30 days of deletion, save for legal retention obligations (e.g. tax data). Reviews are anonymized.
12. Governing Law and Jurisdiction
These Terms are governed by Italian law. For Consumers the competent court is the place of residence/domicile (mandatory under the Italian Consumer Code). For Restaurateurs the competent court is Lecce, Italy.
